答:疫情发生以来,各级政府部门和金融机构纷纷出台了一批支持产业领域企业应对疫情冲击的惠企政策。这些政策有些更加适用于支持中小微企业应对疫情冲击影响,有些也适用于各种所有制和各种规模的企业。

A: Since the outbreak of COVID-19, government departments at all levels and financial institutions have introduced a number of policies to support industrial enterprises in coping with the impact of the epidemic. 答:后续上海市将根据党中央、国务院的部署和要求,进一步深化支持复工复产企业的联合联动、链式保障,在行业、领域等方面进行拓展,包括物流、生产性服务业、产业链配套等企业。

A: Shanghai will, according to the deployment and requirements of the  CPC Central Committee and the State Council, further step up its efforts in supporting the coordination of enterprises that have resumed work and production throughout the industrial chains, and expanding its support to more industries and fields, including logistics, productive service industries, industrial chain supporting enterprises, etc.


24、长三角地区的产业链供应链如何确保安全畅通?

24. How to ensure safe and smooth industrial and supply chains in the Yangtze River Delta?


答:4月30日,长三角地区上海、南京、杭州、宁波、合肥5家直属海关发布联合通告,全力保障长三角地区产业链供应链安全畅通,最大限度减少疫情对经济社会发展的影响。通告具体措施包括五方面。

A: On April 30, Shanghai, Nanjing, Hangzhou, Ningbo and Hefei Customs Districts in the Yangtze River Delta region directly under the General Administration of Customs (GACC) issued a joint circular to ensure safe and smooth industrial and supply chains in the Yangtze River Delta region and to minimize the impact of the epidemic on economic and social development. The specific measures of the circular include the following five aspects.


一是在海关总署指导下,建立由上海、南京、杭州、宁波、合肥海关参与的保通保畅协调工作机制。二是加速上海口岸货物报关和提离。三是建立重点企业重点物资通关绿色通道,统筹长三角地区产业链供应链重点企业名单,实现“白名单”企业五关互认。四是加速长三角地区进出境货物跨关区流转。五是搭建长三角关企信息互通平台,在五个海关的“12360微信平台”共同开设长三角关企互通专栏。

First, under the guidance of the GACC, a coordinated working mechanism is established with the participation of Shanghai, Nanjing, Hangzhou, Ningbo and Hefei Customs Districts to ensure smooth industrial and supply chains. 27、满足复工复产资金需求,哪些重点领域和企业将获得信贷支持?

答:金融机构要加大信贷投放,满足复工复产资金需求,鼓励银行机构单列信贷计划,主动对接民生保障、防疫建设、医药医疗、物资生产等企业需求;对受疫情影响较大的旅游、住宿餐饮、批发零售、交通运输、物流仓储、文化娱乐、会展等行业,加强研判,做好对接,对于有发展前景、信誉良好但暂时流动资金受困的企业,不得盲目抽贷、断贷、压贷。

A: Financial institutions should increase credit issuance to meet enterprises’ financial needs to resume work and production. Banking institutions are encouraged to make separate credit plans and take the initiative to dovetail with the needs of enterprises in the fields of livelihood support, epidemic prevention and construction, pharmaceutical and healthcare, and material production; for such industries as tourism, accommodation and catering, wholesale and retail, transportation, logistics and warehousing, culture and entertainment, convention and exhibition, etc. which are greatly affected by the epidemic, specific plans should be made based on in-depth study. Blindly withdrawing, cutting off or suppressing loans to enterprises that have development prospects and good reputations but are temporarily in liquidity difficulties is prohibited.

 

28、针对复工复产,保险业有哪些支持政策?保险产品有哪些创新?

28. What are the insurance industry's policies to support the resumption of work and production? What are the innovations in insurance products?


答:鼓励保险机构通过减费让利、适度延后保费缴纳时间、扩展新冠肺炎责任、赠送保单等方式,支持受疫情影响较重企业和人群渡过暂时难关。鼓励对受疫情影响较大的旅游业、交通运输业、工程建筑业、餐饮业等,加大保险政策倾斜。

A: Insurance institutions are encouraged to support enterprises and people heavily affected by the epidemic to tide them over the temporary difficulties through fee reductions and concessions, moderate delays in premium payments, extension of liabilities against COVID-19 and free policies. Insurance policies are encouraged to be more favorable to tourism, transportation, engineering and construction, and catering industries, etc. which are more heavily affected by the epidemic.


鼓励保险机构针对企业特定保险需求,在风险可控的基础上,开发设计责任更广、价格更低、覆盖更全的责任保险、营业中断险、复工复产复市疫情防护综合保险等,不断扩大政策性保险和商业保险的覆盖面,帮助缓解企业和群众的后顾之忧。加大企业财产保险、安全生产责任保险、履约保证保险、健康险、养老险等业务拓展力度,为小微企业生产经营和相关人群提供更多保障。鼓励针对驾驶员、邮政快递人员、医护人员、社区工作者、公益志愿者等定制专属保险方案,提供多元化、全方位、普惠性的保险保障。

Moreover, the coverage of policy-based insurance and commercial insurance should be expanded to help ease the worries of enterprises and the public. In addition, Efforts should be strengthened in expanding enterprise property insurance, production safety liability insurance, performance bond insurance, health insurance and old-age insurance, so as to provide more protection for the production and operation of small and micro enterprises and related people. Insurance institutions are also encouraged to make tailor-made insurance solutions for drivers, postal and courier workers, medical workers, community workers and volunteers to provide diversified, all-round and inclusive insurance protection.


支持在沪保险公司进一步丰富抗疫保险产品供给,扩展新冠肺炎保险保障责任,扩大因疫情导致营业中断险等风险保障的覆盖面,创新推出旅行社旅游服务质量保证金履约保证保险。加强抗疫保险保障服务,研究推出适当延长保单期限、降低保险费率、延后保费缴纳时间等措施,建立保险理赔绿色通道,提升理赔效率。

29、支持企业复工复产,对流动性困难企业有哪些延期还款支持?

答:对今年受疫情影响较大,但有还款意愿、吸纳就业能力强的行业和中小微企业,支持银行机构按照市场化原则,双方自主协商确定通过续贷、展期等方式纾困解难,原则上做到能续尽续、应续尽续,尽力支持市场主体复工复产。

A: For industries and micro, small & medium-sized enterprises which have suffered a lot from this year’s epidemic but show the willingness to repay loans and have the stronger capability to create jobs, banking institutions are encouraged to help them to resolve difficulties through loan renewal, extension or other methods upon consultation between both parties based on market-oriented principles. In principle, any loan which is eligible for and deserves renewal should be renewed to support market entities’ resumption of work and production to the greatest extent.


小额贷款公司、典当行等可通过展期、无还本续贷、延长还款期限或当期、实施征信保护等方式减轻客户还款压力,对于受疫情影响未能及时还款或办理赎当、续当的客户适当暂缓催收,确保不因疫情导致的办理不便而增加客户额外融资息费,不盲目抽贷、断贷、压贷,不盲目做````处理。

Small-loan companies and pawnshops can reduce the pressure on their customers by loan extension, loan renewal without repayment of principal, extended repayment periods or pawn periods, and protection of personal credit information. For customers failing to repay a loan or redeem a pawned article in time due to impacts of the epidemic, requesting repayment should be deferred reasonably. It is necessary to ensure that no additional financing interest or fee is incurred to customers due to the inconvenience in processing caused by the epidemic. 30、针对产业链复工复产有哪些金融纾困支持措施?

答:支持核心企业通过信贷、债券等方式融资后,以适当方式减少对上下游企业的资金占用,帮助产业链上下游中小微企业解决流动资金紧张等问题。通过应收账款融资、订单融资、预付款融资、存货与仓单质押融资等方式,加大对产业链上下游中小微企业的信贷支持。增加外贸信贷投放,加大出口信用保险覆盖面,支持全球产业链协同发展。

A: Core enterprises are supported to finance through credit, bonds and other methods so as to reduce occupancy of the funds of upstream and downstream enterprises in an appropriate way, and help ease working capital of the upstream and downstream micro, small & medium-sized enterprises in the industry chains. Through accounts receivable financing, order financing, prepayment financing, inventory and warehouse receipt pledge financing, credit support for upstream and downstream micro, small & medium-sized enterprises in the industry chains is increased. 31、疫情期间,企业如果面临一些生产许可证到期怎么办?

31. What if a company faces expiration of some production licenses during the epidemic?


答:以食品生产企业为例,如果食品生产许可证到期,因疫情影响无法办理许可证延续的,食品生产许可证有效期顺延至本市疫情解除后1个月。

A: Taking food production enterprises for example. If the food production license expires and license renewal cannot be processed due to impacts of the epidemic, the validity period of the food production license is extended to one month after end of the epidemic in the city.


同时,食品生产企业应加强员工健康管理,禁止安排患有国务院卫生行政部门规定的有碍食品安全疾病的人员从事接触直接入口食品的工作。对于食品从业人员因疫情影响暂时无法重新进行健康检查的,其健康证明在2022年3月1日后到期的,视为继续有效,相关从业人员应在本市疫情解除后1个月内办理健康证明。

In addition, food manufacturers should strengthen employees’ health management, and it is prohibited to arrange personnel with a disease stipulated by the health administrative department of the State Council which harms food safety to engage in the work of processing food which is consumed directly. If a food practitioner cannot receive a physical exam for the time being due to impacts of the epidemic and his/her health certificate expires after 1 March 2022, the certificate continues to be deemed valid, and the practitioner should apply for a new health certificate within one month after end of the epidemic.


32、环评如何支持企业复工复产?

32. How can Environmental Impact assessment (EIA) support the resumption of work and production of enterprises?


答:上海市生态环境局于4月30日出台了《关于疫情期间优化环评与排污许可管理支持企业复工复产的通知》,从优化环评和排污许可手续办理方式,统筹衔接环评与排污许可试点改革政策,转变事中事后监管方式,强化政府服务与技术支持等方面出台13条支持政策。

A: The Notice on Optimizing EIA and Sewage Discharge License Management to Support Enterprises’ Resumption of Work and Production during the Epidemic issued by the Shanghai Municipal Bureau of Ecology and Environment on April 30 provides 13 support policies, such as optimizing the processing of EIA and sewage discharge licenses, coordinating the pilot reform policies of EIA and sewage discharge licensing, changing concurrent and ex-post regulation, and strengthening government services and technical support.


比如,豁免抗疫保供类项目的环评和排污许可手续。对医疗机构改扩建、集中隔离点或方舱医院新改扩建、抗疫保供物资生产、研究实验等临时性抗疫保供项目的环评及排污许可手续予以豁免。

For example, EIA and sewage discharge license formalities for anti-epidemic and supply-ensuring projects are exempted. EIA and sewage discharge license formalities for temporary projects related to anti COVID-19 and ensuring supplies are exempted,  such as the construction, reconstruction and expansion of medical institutions, centralized isolation points and mobile cabin hospitals, the production of anti-epidemic materials and daily essentials and research and experiments.


适当延长建设项目竣工环境保护验收期限。原计划于2022年上半年完成竣工环保验收的建设项目,因疫情防控导致无法按期完成的,验收工作可顺延至本轮疫情社会面解控后的3个月内完成。延长排污许可证有效期。因受疫情影响,无法在2022年3月1日至6月30日期间完成到期排污许可证的延续或换发手续的排污单位,可在本轮疫情社会面解控后的3个月内办理手续,期间排污许可证仍然有效。

The environmental protection acceptance period after completion of a construction project is extended to a reasonable extent. For construction projects which were originally planned to complete the environmental protection acceptance in the first half of 2022, if acceptance cannot be completed as scheduled due to the epidemic prevention and control, it can be postponed and performed within three months after the lockdown for this round of epidemic is removed. The validity period of sewage discharge licenses is extended. For a unit which cannot finish the extension or renewal of the sewage discharge license during 1 March to 30 June 2022 due to impacts of the epidemic, it may go through relevant formalities within three months after the lockdown for this round of epidemic is removed. The sewage discharge license is still valid during the period.


全力保障重大项目及支柱产业发展。对列入市、区重大项目清单的建设项目以及本市支柱产业的部分建设项目,实施技术评估提前介入,专人跟踪指导,定期调度进度等保障措施,确保项目早开工、早投产。

We spare no effort to ensure the development of major projects and pillar industries. 33、疫情防控期间,如何实现信用修复?

答:为充分发挥社会信用体系建设在疫情防控中的积极作用,进一步完善信用修复工作机制,助力各类市场主体稳定发展,上海市发展改革委(市信用办)制定了《关于疫情防控期间进一步完善信用修复工作机制助力市场主体稳定发展的实施方案》。

Shanghai has established a rapid credit restoration mechanism for combating the epidemic. For enterprises producing anti-epidemic materials and ensuring the supply of daily essentials that have been included in the list of untrustworthy persons subject to enforcement, they may apply for credit restoration to the enforcing courts on the online litigation platform of Shanghai’s courts and other channels with relevant certificates issued by Shanghai Municipal Commission of Economy and Information Technology and Shanghai Municipal Commission of Commerce. The enforcing courts shall make an decision within three working days from the date of receipt of the application. For an applicant whose credit is restored upon review, the Municipal Public Credit Information Service Center will withdraw the untrustworthy message within one working day after receiving restoration notice. A "fast-track” credit work mechanism is also established for taxation. For key enterprises for epidemic prevention & control, the process of supplementary credit evaluation, credit re-evaluation, and credit restoration will be completed within one working day to provide convenient and efficient services for enterprises.


完成失信被执行人名单信用修复的企业,因融资、招投标等需要提供信用修复证明的,执行法院应当收到申请后3个工作日内出具相关证明文件。进一步优化信用修复标准,除法律法规和国家规定不予修复的信息,对涉及交通、城管执法等领域的行政处罚信息信用修复申请,在履罚后及时予以修复。

For enterprises which have restored credit, if they require a credit restoration certificate for financing, bidding, etc., the enforcing courts shall issue relevant documents within three working days after receipt of an application. Credit restoration standards are further optimized. Except the information which can not be restored according to laws and regulations as well as state regulations, applications for credit restoration of administrative punishment involving traffic, urban management law enforcement and other fields, a timely restoration will be made after the punishment is done.


在“一网通办”网站、“随申办”APP、“信用中国(上海)”网站上等为企业开设信用修复申请专栏。通过线上查询、手机短信提示等多样化方式供企业了解办理进度、获取修复证明文件。优化信用修复申请流程、缩减申请材料,加快上线电子签章功能,对能够通过数据共享核实的身份证明、信用报告等材料,不再要求企业提交。

Dedicated columns for credit restoration application are established for enterprises on the website of "Government Online-Offline Shanghai", “Suishenban” app, and the "Credit China (Shanghai)" website. Enterprises can learn about the progress of processing and acquire a restoration certificate by several means including online inquiry and mobile phone SMS prompts. Measures such as optimizing the application process of credit restoration, reducing application materials, speeding up the online electronic signing function are unveiled, and enterprises are not required to submit identity certificates and credit reports and other materials that can be verified by data sharing.


34、用人单位受疫情或疫情防控措施影响致生产经营困难的,是否可缓发劳动者工资?

34. If an employer encounters production and operation difficulties due to impacts of the epidemic or epidemic prevention and control measures, is it allowed to defer the payment of workers’ compensation?


答:根据人力资源社会保障部等部门《关于做好新型冠状病毒感染肺炎疫情防控期间稳定劳动关系支持企业复工复产的意见》的有关指导意见以及《上海市企业工资支付办法》第十条的规定,企业受疫情或疫情防控措施影响致生产经营困难,暂时无法按时支付工资的,经与工会或职工代表协商同意后,可暂时延期支付劳动者工资,但延期支付时间一般不超过一个月。

A: According to the Opinions on Maintaining a Stable Labor Relationship to Support Enterprises’ Resumption of Work & Production during the Epidemic Prevention and Control issued by the Ministry of Human Resources and Social Security and Article 10 of the Measures of Shanghai on Salary Payment of Enterprises, if an enterprise cannot pay salary to its people in time for the time being due to production and operation difficulties caused by the epidemic or epidemic prevention and control measures, it may temporarily postpone the payment of salary after consulting and reaching an agreement with the union or employee representatives, but the payment generally cannot be deferred for more than one month.


35、受疫情或疫情防控措施影响,用人单位因停工停产、暂时性生产经营困难等原因,未及时足额支付劳动者劳动报酬或者未依法为劳动者缴纳社会保险费的,劳动者以此为由提出解除劳动合同并要求用人单位支付经济补偿的,应如何处理?

35. 答:对于因疫情或疫情防控措施影响导致停工停产或暂时生产经营困难的用人单位,特别是中小微企业,未及时足额支付劳动者劳动报酬或未依法缴纳社会保险费等引发劳动者解除劳动合同纠纷的,应注重通过和解、调解等方式,着力化解矛盾,促成双方恢复劳动关系,继续履行劳动合同。劳动者坚持要求依据《中华人民共和国劳动合同法》第三十八条的相关规定解除劳动合同并主张用人单位支付经济补偿的,应坚持审慎处理的原则,一般不予支持。

A: In the event that an employer, especially a micro, small or medium-sized enterprise, fails to timely pay compensation in full or fails to pay social insurance pursuant to the law due to suspension of operation or temporary production and operation difficulties caused by the epidemic or epidemic prevention and control measures, an employee therefore requests termination of the employment contract.
